Kyle James Murphy fled the scene of the accident and was unable to be located until the next day and therefore unable to be breath tested.

His solicitor Tim Dalla argued in Orange Local Court two of the charges, which included negligent driving, not giving particulars to owners of damaged property and driving with an expired licence, could have been dealt with by a traffic infringement notice but instead police chose to take him to court. 

On February 28 at 7pm, Murphy was driven to a pub in his own car by a friend.

While at the pub he had two to three schooners of full-strength beer and then chose to drive to his north Orange home about 9.40pm.

He miscalculated a right-hand turn and ran his car into a house in William Maker Drive.

He then reversed the car into a light pole on the footpath then drove off. 

The house sustained damage to the brick work and a down pipe.

Police facts said several witnesses saw the event and were able to provide police with a registration number for the car. 

On March 1 police found the car at Muphy’s Bella Vista Close home with damage to its front and flat tyres. 

He was arrested and admitted the crash. He told them he had fled because he did not have a licence. 

Mr Dalla said his client’s “maths was wrong with respect to how long his L plates ran for”. 

He said he did not realise they had expired. 

“He hasn’t reapplied for his L’s because of these matters hanging over his head,” Mr Dalla said.

The magistrate, Terry Lucas, fined the 22-year-old $600 for each offence.

“You left the scene, a person who has their property destroyed usually has no way of recompense ... you are lucky you’re here,” he said.
